We reserve the right to suspend or terminate services if payment is not received on time. All fees are non-refundable unless otherwise stated in writing.

5. Intellectual Property

Upon full payment for our web design services, you will own the final website and its assets. We retain the right to showcase the completed work in our portfolio and marketing materials. Any pre-existing intellectual property, tools, or frameworks used by Client Gen AI remain our exclusive property.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Client Gen AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services.

7. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the services will immediately cease.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
